Section 1 - Transparency and modalities<\/h3>\n

Article 11 introduces the obligation for data controllers to provide transparent, easily accessible and understandable information, inspired especially by the Madrid Resolution on international standards on personal data protection and privacy32.<\/p>\n

Article 12 obliges the controller to provide procedures and mechanisms for the exercise of data subjects' rights, including the means for submitting electronic requests, with the obligation to respond to the data subject's request within a specified period, and to give reasons for refusals.<\/p>\n

Article 13 establishes rights in favor of recipients, based on Article 12(c) of Directive 95\/46\/EC, and extended to all recipients, including joint controllers and co-processors.<\/p>\n

Section 2-Information and access to data<\/h3>\n

Article 14 elaborates on the information obligations of the controller in relation to the data subject, based on Articles 10 and 11 of Directive 95\/46\/EC, and provides for the provision of additional information to the data subject, including on the data retention period, the right to lodge a complaint, in relation to international transfers and the source from which the data originate. It also maintains the possible derogations from Directive 95\/46\/EC, i.e. there will be no such obligation if the recording or communication is expressly provided for by law. This could apply, for example, to procedures handled by competition authorities, tax or customs administrations or social security services.<\/p>\n

Based on Article 12(a) of Directive 95\/46\/EC, Article 15 provides for the data subject's right of access to his or her personal data and adds new elements, such as the obligation to inform data subjects about the retention period, the rights of rectification and erasure, and the right to lodge a complaint.<\/p>\n

Section 3 - Rectification and deletion<\/h3>\n

Based on Article 12(b) of Directive 95\/46\/EC, Article 16 establishes the data subject's right to rectification.<\/p>\n

Article 17 establishes the data subject's right to be forgotten and the right to erasure. It further elaborates and specifies the right to erasure provided for in Article 12(b) of Directive 95\/46\/EC and sets out the conditions for the right to be forgotten, including the obligation of the controller who has disseminated the personal data to inform third parties of the data subject's request to erase all links to, copies or replicas of personal data. It also integrates the right to have processing restricted in certain cases, avoiding the ambiguity of the term \"blocking\".<\/p>\n

Article 18 introduces the right of the data subject to data portability, i.e. to transfer data from one electronic processing system to another, without being prevented from doing so by the controller. As a precondition and in order to further improve the access of individuals to their personal data, it establishes the right to obtain from the controller such data in a structured and commonly used electronic format.<\/p>\n

Section 4 - Right to object and profiling<\/h3>\n

Article 19 establishes the data subject's right to object. It is based on Article 14 of Directive 95\/46\/EC, with some modifications, especially as regards the burden of proof and its application to direct marketing.<\/p>\n

Article 20 concerns the data subject's right not to be subject to a measure based on profiling. With additional modifications and safeguards, it is based on Article 15(1) of Directive 95\/46\/EC on automated individual decisions, and takes into account the Council of Europe Recommendation on profiling.<\/p>\n
